The question appears in every FiveM forum, Discord, and community: is Rockstar going to ban my server? Given Rockstar's history with modders — including cease-and-desist letters, lawsuits, and the infamous OpenIV takedown attempt — the concern is understandable. Before August 2023, FiveM existed in a legal gray area. The Cfx.re team operated without Rockstar's permission, using a modified GTA V network layer to enable custom multiplayer. Rockstar could have sued at any time. They chose not to.

In August 2023, Rockstar Games announced the acquisition of Cfx.re — the team behind FiveM and RedM. This was not a hostile takeover but a recognition that the modding community had become essential to GTA V's longevity. Rockstar hired the developers they could have sued.
The implications are clear: FiveM is now an official Rockstar product. The company is not going to ban servers using its own platform. They are investing in its future through Project Rome, which aims to bring official modding support to GTA 6.
What Rockstar Actually Bans
Rockstar's ban policy targets specific behaviors, not FiveM usage:
- GTA Online modding that affects other players. Using mod menus to grief, cheat, or exploit in GTA Online will get your Rockstar account banned. This has nothing to do with FiveM.
- Real-money trading (RMT) in GTA Online. Selling GTA Online currency or accounts violates the terms of service.
- Copyright infringement at scale. Servers that mass-distribute copyrighted content (music, real brand assets without permission) may face DMCA takedowns.
Running a FiveM server with custom scripts, jobs, and roleplay does not violate any of Rockstar's stated policies. The company's acquisition of Cfx.re implicitly endorses the entire ecosystem.
The Real Risks for Server Owners
The bigger threats to your server are not Rockstar bans. They are:
- Copyright claims from third parties. Real car manufacturers have targeted FiveM mod sites for using their brand assets without permission. This is a legal risk, but enforcement is sporadic.
- Tebex/Stripe account issues. If you monetize your server through Tebex, ensure your offerings comply with their terms. Selling GTA Online mods or cheats through Tebex will get your account terminated.
- Community drama and DDoS. The most common reason servers shut down is not legal action — it is internal conflict and targeted attacks from competitors.
- FiveM updates breaking scripts. Major FiveM updates can break escrowed scripts with abandoned developers, forcing server owners to rebuild systems.
The Bottom Line
Your FiveM server is not going to be banned by Rockstar. The company owns the platform. Focus your energy on building a great community, not worrying about hypothetical legal threats from a company that just hired FiveM's developers.
